2. Definitions

In short: this section explains the terms we use in the rest of the text.

3. Acceptance of the Terms and conclusion of the contract

In short: you enter into a contract with us when you tick the box accepting these Terms during registration. As a Guest you use a limited part of the App under the same rules.

3.1. You accept these Terms when you open an Account, by ticking the box "I accept the Terms of Service and confirm that I have had access to the Privacy Policy" before completing registration, regardless of whether you register by e-mail, with Apple sign-in or with Google sign-in. Without acceptance of the Terms an Account cannot be opened.

3.2. The contract between you and us is concluded at the moment you confirm registration with the Terms accepted. The Terms are shown to you in full before acceptance and you can reopen them at any time in the App (Settings) and at https://picusgo.com/uvjeti. After registration we send you a confirmation by e-mail with a link to the version of the Terms you accepted.

3.3. We record the date, time and version of the Terms you accepted. This is our evidence of the concluded contract and of the licence to Content under Article 9.

3.4. If you use the App as a Guest, you have no Account, but you accept these Terms on first use of the App to the extent they apply to a guest session (in particular Articles 5, 7, 8, 10, 19 and 21). A Guest cannot post content, comment or write in the chat before opening an Account and accepting these Terms. When a Guest opens an Account, the progress from the guest session is transferred to the Account.

3.5. If you accept these Terms on behalf of a legal entity (for example a school, a company or an association), you warrant that you have the authority to bind that legal entity.

3.6. The Privacy Policy is not part of this contract and is not "accepted"; it is a notice we give you under personal data protection law. We recommend that you read it before registering.

4. Who may use the App (age)

In short: PicusGO is for people aged 13 and over. If you are between 13 and 16, features that need consent are switched on only with the approval of a parent or guardian. Physical prizes are collected by adults.

4.1. The App may be used by people aged 13 and over. If you are under 13, you cannot open an account. If you are between 13 and 16 and live in the EU, you can use the core features without separate consent, because they are based on the contract, and features that need your consent (notifications that are not service notifications, analytics, promotional use of your content) are switched on only with the approval of a parent or guardian, in line with the age limit of the country where you live (Croatia and Germany 16, France 15, Spain 14). If you are under 18, point 7.5 also applies to your safety in the field.

4.2. If the law of the country you live in sets a minimum age higher than 13 for independent use of services like this one, that higher age applies. The consent age limits in point 4.1 do not decide whether you may use the App; they only decide when the approval of a parent or guardian is needed for particular features.

4.3. When registering you confirm that you are at least 13 years old. If we learn that the App is used by a person under 13, we will close the Account and act in accordance with the Privacy Policy. If we learn that a person between 13 and 16 is using features that need consent without the approval of a parent or guardian, we switch those features off. A parent or guardian can contact us at privatnost@picusgo.com to check, restrict or delete a child's Account.

4.4. Physical prizes (Article 13) are available only to adults, or to minors with the involvement of a parent or guardian who enters their own delivery details.

4.5. Some features of the App, in particular the generation of Card images by artificial intelligence, may be available only to people over 18 if the terms of the technology provider we use require this. In that case we will clearly indicate in the App which features are not available.

5. What PicusGO is and what it is not

In short: PicusGO is a game and a community tool for mapping and caring for trees. It is not a land register, it is not a professional tree assessment and it is not an emergency service. All features are free.

5.1. PicusGO lets you photograph and map trees, record tree stories about them, report problems in nature, collect Cards, earn EIT points, take part in leagues and leaderboards, complete quests and quizzes (for example EkoŠkolica, the daily eco quiz), post in Šumarnik, talk in Čavrljanje and use EIT points to digitally "protect" trees (Article 16).

5.2. All features of the App are free; there are currently no purchases or payments in the App (Article 15). We provide the App to you in the form in which it currently exists; features are developed and changed in accordance with Article 20.

5.3. PicusGO is not:
- an official tree register, land register, spatial plan or proof of ownership, boundaries or the legal status of land;
- a professional arboricultural, forestry, construction or safety assessment; data on the species, age, height, health, danger and CO2 effect of a tree are estimates (some of them produced by artificial intelligence) and may be inaccurate;
- an emergency service or a substitute for one (see Article 8);
- a financial product; EIT points have no monetary value (see Article 12);
- permission to enter someone else's land or to carry out any action on a tree (see Article 7).

5.4. To use the App properly you need a device with a supported version of iOS or Android, internet access, a camera and location services. You bear the cost of data traffic under the contract with your mobile operator. We publish the minimum system versions in the app stores.

6. User account, guest, security and account deletion

In short: you open an Account by e-mail, with Apple sign-in or with Google sign-in. Keep access to your account safe. You can delete your Account in Settings; deletion becomes permanent after 30 days.

6.1. Opening an Account. You open an Account with an e-mail address and a password, with Apple sign-in or with Google sign-in. From Apple or Google we receive only the basic data needed for sign-in (identifier, e-mail address, possibly a name). By signing in through those services you also accept their terms as they apply to you; we do not control them.

6.2. Accurate details. The details you enter (e-mail address, nickname, optionally name, city, country) must be accurate and your own. Your nickname must not be offensive, must not impersonate another person and must not contain advertising. You may have only one Account, unless we approve otherwise in writing.

6.3. Guest. As a Guest you can try out part of the App without an Account. Guest progress is tied to the device and the guest session; if you delete the App before opening an Account, the progress may be lost.

6.4. Access security. You are responsible for everything that happens through your Account, unless the misuse occurred because of a failure on our side. Do not share your password, do not hand your Account over to others, and tell us immediately at podrska@picusgo.com if you suspect that someone else is using your Account. We never ask for your password by e-mail or message.

6.5. What you must not do. You must not access the App or its interfaces with automated tools (bots, scripts, bulk downloading), circumvent technical protections, spoof your location, artificially create activity or accounts in order to obtain EIT points, Cards, rankings or prizes, interfere with the operation of the App, or attempt to access other people's data.

6.6. Deleting your Account. You can delete your Account in the App (Settings, then Delete account) or by request to privatnost@picusgo.com, and instructions are also available at https://picusgo.com/brisanje-racuna. After the request, the Account is inactive for 30 days and you can restore it by signing in again with the same credentials. After 30 days the Account is permanently deleted.

6.7. What remains after deletion. When you ask for deletion, your Account is deactivated straight away, but for 30 days it can be restored with your full balance of EIT points, Cards and progress. Once those 30 days have passed, EIT points, Cards, frames, progress and rankings end irreversibly. Trees you mapped, as well as Reports, remain on the shared map because they are part of the community's ecological record, but without your name and nickname (they are shown as an anonymous entry). Your posts and comments in Šumarnik are removed or anonymised. The details, the deadlines and the legal basis for retaining pseudonymised data are explained in the Privacy Policy.

6.8. Our right to close an Account is governed by Article 11.

7. Safety in the field

In short: trees are in the real world. Take care of yourself and of others. Do not climb, do not touch damaged trees, do not enter other people's land, do not scan while driving. A tree shown in the App does not mean that approaching it is safe or allowed.

7.1. The App encourages you to go outside and be among trees. Being outdoors carries risks that we cannot remove or supervise: uneven and slippery terrain, falling branches, damaged or rotten trees, traffic, weather, animals, insects, allergens (for example ragweed), water, heights and darkness. You decide where you go and what you do, and you assess for yourself whether it is safe.

7.2. You undertake that while using the App you will:
- pay constant attention to your surroundings and not look at the screen while walking along a road, crossing a road, or riding a bicycle, a scooter or a vehicle; do not use the App while operating any vehicle;
- not climb trees, fences, walls or other structures, and not touch, shake, cut or otherwise damage trees;
- not approach a tree that looks damaged, leaning, dead, cracked or dangerous, or any tree during strong wind, a storm, thunder, ice or snow;
- not enter fenced, marked or obviously private land, construction sites, industrial zones, railway corridors, military areas or protected areas without permission; scan only from a place where you are allowed to be;
- respect the rules of protected areas, parks, forests, cemeteries, school grounds and similar places;
- not obstruct traffic, not stop on the roadway, not park illegally in order to scan;
- behave as a visitor in a forest: a forest is open to visitors within the meaning of the Croatian Forests Act (Zakon o šumama), a visit is at your own risk, and the forest owner is not obliged to take special precautions for visitors;
- respect other people's privacy: do not film people who do not want to be filmed and do not film into other people's yards, windows or private spaces;
- not put yourself or others in danger for the sake of EIT points, Cards, rankings or prizes.

7.3. The fact that a tree, a Report or a quest is shown in the App does not mean that approaching that place is safe, permitted or lawful. Trees in the App are mapped by other users; we do not verify locations in the field. If you cannot reach a tree safely and lawfully, do not go. No goal in the game is worth an injury or a breach of the law.

7.4. The App gives you no right to enter someone else's land and no right to carry out any action on a tree or on land. If a tree is on private land, map it only from a public area or with the owner's permission.

7.5. If you are under 18, use the App in the field with the knowledge of, and depending on your age under the supervision of, a parent or guardian. The parent or guardian is responsible for the child's safety.

7.6. If by using the App you cause damage to someone (for example you enter someone else's land, damage a tree or a fence), you are liable for that damage.

7.7. This section does not exclude our liability where the law does not allow it to be excluded (see Article 21). It describes what you should do so that using the App is safe, and a court will take your conduct into account when assessing who is responsible for what.

8. Reporting dangerous trees and problems in nature

In short: a Report in the App is not a call to the emergency services. If anyone is in danger, call 112. We forward Reports to the competent services where we can, but we do not guarantee that they will act.

8.1. Through the App you can report a dangerous tree, an illegal waste dump, a field of ragweed, a suitable planting spot and similar problems. A Report contains a photograph or video, a location, a description and, where applicable, an assessment produced by artificial intelligence (Article 14).

8.2. A Report is not an emergency call. If a tree or another problem is an immediate danger to people, traffic or property (for example a branch fallen on a road, a tree about to collapse, a fire), call 112 immediately or the competent services in the country you are in. The App does not monitor Reports in real time and has no on-call service.

8.3. A Report is not a professional assessment. The danger rating in the App, including the assessment produced by artificial intelligence, is indicative and does not replace an inspection by a certified arborist or a forestry or municipal expert. Do not rely on the App for decisions about felling, pruning, safety or investment.

8.4. Forwarding. We aim to forward Reports from Croatia to the competent city and municipal services, or to cooperate with them in the way they choose themselves. Forwarding depends on the cooperation of those services and we do not guarantee that a Report will be forwarded, received, processed or resolved within any deadline. By forwarding a Report we do not assume any obligation to supervise the tree, nor the responsibility of the competent services or of the owner.

8.5. Reports are public. Reports, including photographs, exact coordinates, description and status, are publicly visible in the App and on the web reports portal, because the purpose of a Report is for the community and the services to learn about the problem. As the reporter, you are shown according to the level you have chosen in Settings (Article 9.9): your nickname (default), your first and last name (your choice) or "Private user" (private entry). The location and the photograph remain public at every level. Do not report anything that you do not want to be public.

8.6. Accuracy and good faith. Report only what you have actually seen, with an accurate location. False, offensive, retaliatory or repeatedly duplicated Reports are prohibited, as are Reports that unnecessarily reveal other people's personal data (faces, licence plates, house numbers in a private context). You are liable for damage caused by a false Report.

9. Your content (photographs, video stories, posts, comments)

In short: your Content stays yours. You give us a free, non-exclusive, worldwide licence to use it to run and promote PicusGO. Photographs and locations of trees and Reports are public. If you film other people, you need their consent.

9.1. Your rights stay yours. You remain the holder of the copyright and other rights in the Content you upload. You do not transfer your copyright to us and you do not waive it.

9.2. The licence you grant us. For the Content you upload to the App you grant Agilos IT d.o.o. a right of exploitation of that Content which is:
- non-exclusive (you may continue to use the Content however you wish),
- free of charge; we expressly agree that the right is granted without remuneration, because the App is free for you and the Content is used for the work of the community,
- worldwide (the App is available throughout the world),
- unlimited in time for what has already been published or used, subject to the termination rules in point 9.6,
- transferable and sublicensable only to the extent necessary to run the App: to our providers of storage, content delivery networks, artificial intelligence processing, distribution through app stores and social networks, and to the agencies that carry out promotion for us, who use the Content only for our purposes.

9.3. The forms of use you authorise are: reproduction (storage, backups, copies for display), distribution, communication to the public including making available to the public over the internet and through the App, public display, and adaptation in the following forms and for the following purposes: framing, cropping, changing the format, size and resolution, compression, correcting orientation, blurring parts (for example faces or licence plates), adding labels, logos, text and frames, combining with other content into Cards, collages and montages, adding subtitles and translation. You expressly authorise such adaptations for the purposes set out in point 9.4 and agree that they do not affect the essential character of your Content.

9.4. The purposes for which we may use the Content:
- running the App: display on the map, in Šumarnik, on leaderboards, in leagues, on Cards, on the reports portal and in other parts of the App, including display to other users and to the public;
- processing by artificial intelligence for species identification, assessment and moderation (Article 14);
- forwarding Reports to the competent services (Article 8);
- promotion of the App and of the PicusGO community: posts on our channels, on social networks, on websites, in app stores, in presentations to partners and cities, in media publications and in printed materials.

9.5. Content showing identifiable people. If Content shows an identifiable person or their voice can be heard, we will use it only inside the App and for forwarding Reports. For promotion outside the App we use such Content only with your separate consent, given through a separate, unticked checkbox, which you can withdraw at any time. We do not use Content showing an identifiable minor in promotion.

9.6. End of the licence. If you delete a particular piece of Content or your Account, the licence ends for future uses. It remains only for: (a) Content already incorporated by that time into published promotional materials, Cards or printed products, (b) copies that other users have legitimately shared inside or outside the App, (c) backups until the retention period in the Privacy Policy expires, and (d) Content that is part of a Report forwarded to a competent service. Tree data (species, location, photograph of the tree) is retained in anonymised form in accordance with Article 6.7.

9.7. Attribution. You agree that your nickname is credited as the author of the Content, and where the form of use does not allow this (for example on a Card or in a montage), you state that you do not wish to be credited as the author. You can revoke that statement in writing with effect for future uses.

9.8. Your warranties. For every piece of Content you upload you warrant that:
- you recorded it yourself, or that you hold all the rights needed to grant this licence;
- it was recorded from a place where you were allowed to be and without infringing anyone's possession or privacy;
- every identifiable person and every person whose voice can be heard consents to the recording and to its use under these Terms, and for minors their parent or guardian consents;
- the Content is not prohibited under Article 10;
- the Content is not faked or taken from the internet and shows what you claim it shows (for example a tree you really photographed at the stated location).

9.9. Content is public, and how you are shown. Photographs of trees, the locations of trees and Reports, and your avatar are publicly visible to everyone, including people who are not users of the App, on the map and on the web portal. Video stories, posts, comments and messages in Čavrljanje are visible to other users of the App. Video stories are automatically published in Šumarnik. You choose how you are shown as the author in Settings, at three levels:
- first level, default: your nickname is shown;
- second level, your choice: your first and last name (and company) are shown next to trees, Reports, stories, leaderboards and your profile; they are then also visible to everyone on the public web (the tree map and the reports portal), without signing in;
- third level, private entry: "Private user" is shown instead of your name and nickname.
For Accounts of people under 16, only the nickname is shown until a parent or guardian approves otherwise. No level, not even private entry, hides the location or the photograph. We show tree locations precisely, because without this a tree cannot be found; do not map trees whose location would reveal something you want to keep private (for example a tree in your own yard).

9.10. Other users' Content may be viewed and shared by you only using the features the App offers. You must not download, copy or use it outside the App without the permission of the person who published it, except within statutory exceptions.

9.11. Our right to remove. We may remove or restrict Content that breaches these Terms or the law in accordance with Article 11.

10. Community rules and reporting content

In short: be polite and honest. Insults, threats, hate speech, fake trees, other people's personal data, advertising and anything unlawful are prohibited. You can report content in the App and block a user.

10.1. Prohibited content and conduct. In the App you must not publish, send or do the following:
- insults, harassment, threats, intimidation, blackmail, incitement to violence or self-harm;
- hate speech or discrimination on the basis of race, ethnicity, religion, sex, sexual orientation, disability, age or any other characteristic;
- sexually explicit content, content that sexualises children, content showing cruelty to people or animals;
- other people's personal data without permission (name and address, telephone number, faces in a private context, licence plates, documents), or content that reveals where someone lives;
- fake trees, fake locations, other people's or downloaded photographs presented as your own, artificially created activity, multiple Accounts for an advantage;
- false, misleading or retaliatory Reports (Article 8);
- unsolicited advertising, adverts, chain messages, links to malicious sites;
- content that infringes other people's copyright, trade marks or other rights;
- content that encourages entering other people's land, damaging trees, committing offences or behaving dangerously;
- anything unlawful under the law of Croatia or of the country you are in.

10.2. Reporting content. You can report any post, comment, message, story, Report or profile directly in the App (the "Report" option next to the content) or by e-mail to podrska@picusgo.com. So that we can process your report, please state: (a) why you consider the content unlawful or contrary to the Terms, (b) the exact link to, or a description of, where the content is, (c) your name and e-mail address if you are reporting by e-mail (in the App we identify you by your Account) and (d) a confirmation that you are submitting the report in good faith. We confirm receipt of the report without delay and inform you of the decision together with information on how to appeal. You can also submit reports if you are not a user, by e-mail.

10.3. Blocking. You can block another user in Čavrljanje and in Šumarnik. A blocked person no longer sees your messages and you no longer see theirs in those parts of the App.

10.4. Reports that reveal criminal offences. If a report or content gives us information suggesting a criminal offence involving a threat to the life or safety of a person, we will inform the competent law enforcement authorities, as Article 18 of Regulation (EU) 2022/2065 (Digital Services Act) requires of us.

10.5. Misuse of reports. We may restrict the ability to submit reports for people who repeatedly submit manifestly unfounded reports, after a prior warning with reasons.

11. Moderation, restrictions and account termination

In short: we check content automatically and manually. If we remove something or restrict your Account, you will receive a statement of reasons and you can appeal. Every such decision is ultimately made by a person, not by a machine.

11.1. How moderation works. We check content in the App in three ways:
- automatically: photographs, video stories and Reports go through an artificial intelligence review that assesses whether the content is authentic and appropriate and whether it matches the quest, and that detects the presence of faces and licence plates in order to protect privacy (Article 14); a post or message reported by several independent users within a short period is automatically hidden temporarily until a person reviews it;
- on the basis of reports from users and third parties (point 10.2);
- manually: our moderators review reported and automatically hidden content as well as random samples.

11.2. Measures. Depending on the seriousness and on repetition, we may: warn you; remove or hide content; reduce the visibility of content; temporarily restrict individual features (for example posting or Čavrljanje, usually for 24 hours, for 7 days, or permanently for that feature); cancel EIT points, Cards or rankings obtained by breaking the rules; temporarily freeze your Account; permanently close your Account. We apply measures diligently, objectively and proportionately, having regard to freedom of expression and to your rights.

11.3. Grounds for closing an Account. We may permanently close your Account if: you seriously or repeatedly breach Articles 6, 7, 8, 9 or 10; you cheat in the game, fake your location, trees or activity, use multiple Accounts or automated tools; you endanger the safety of other users or of the system; you use the App for unlawful acts; or if a law or a decision of a competent authority requires this of us. For less serious breaches you first receive a warning. We have zero tolerance for harassment, threats and abuse of other users: we remove such content and may immediately restrict the offender's account pending review.

11.4. Statement of reasons. We will inform you, in the App or by e-mail, of every measure affecting your content, your features or your Account, stating: what was done and for how long, which facts were decisive, whether an automated tool was used in the decision, which provision of the Terms or of the law the content infringed, and how you can appeal. The only exception is where the content is a high-volume unsolicited commercial message or where a competent authority prohibits us from informing you.

11.5. Human review and appeal. No measure against an Account is carried out purely automatically: an automated system can hide content temporarily or refuse to award EIT points, but the decision to remove content, restrict features or close an Account is made or confirmed by a person. You can appeal against any measure at podrska@picusgo.com within 6 months; the appeal is reviewed by a person who did not make the first decision, where this is organisationally possible, and we reply within 15 days. If the appeal is well founded, we lift the measure and restore what was cancelled.

11.6. Consequences of closure. Closing an Account ends the contract. EIT points, Cards and progress end without compensation, because they have no monetary value (Article 12). Data is deleted or anonymised in accordance with Article 6.7 and the Privacy Policy.

11.7. Statement on the size of the undertaking. PicusGO is a hosting service and an online platform within the meaning of Regulation (EU) 2022/2065 (Digital Services Act), because it stores and publicly disseminates content posted by users. Agilos IT d.o.o. qualifies as a small enterprise within the meaning of Commission Recommendation 2003/361/EC, so the obligations in Section 3 of Chapter III of Regulation (EU) 2022/2065 (Digital Services Act) do not apply to PicusGO (Article 19 of that Regulation). We fully comply with the obligations in Articles 11, 12, 14, 16, 17 and 18 of that Regulation, and we offer the internal complaint system in point 11.5 voluntarily. The Digital Services Coordinator in the Republic of Croatia is the Croatian Regulatory Authority for Network Industries (HAKOM).

12. EIT points

In short: EIT are points in the game. They are earned through activity, they have no monetary value, and they cannot be bought, sold, transferred or paid out. They are spent only inside the App.

12.1. What EIT is. EIT is an exclusively internal, virtual unit that Agilos IT d.o.o. records in its own system in order to track your activity and to enable access to certain content and features of the App (for example digital tree protection, continuing a quiz, Card frames). EIT has no monetary value and does not represent money, currency, a deposit, a security or any property of yours.

12.2. Not a claim. Your EIT balance does not represent a monetary claim against us, nor an obligation on our part to make any payment. The display of the balance is for information only.

12.3. A right of use, not ownership. You do not acquire ownership of EIT points. We grant you a personal, non-transferable, non-exclusive and revocable right to use them inside the App, in accordance with these Terms.

12.4. No payout. EIT cannot be paid out, exchanged or redeemed for money, goods or services outside the App.

12.5. No transfer. EIT cannot be transferred to another user or to a third party, given away, left in an inheritance, pledged, sold or bought. Any such attempt has no effect towards us and constitutes a breach of the Terms.

12.6. Accepted only by PicusGO. EIT is accepted exclusively by Agilos IT d.o.o., and only for content and features that it provides itself inside the App.

12.7. Legal classification. EIT is not electronic money within the meaning of the Croatian Electronic Money Act (Zakon o elektroničkom novcu), it is not a payment instrument or a payment service within the meaning of the Croatian Payment Transactions Act (Zakon o platnom prometu), it is not a crypto-asset within the meaning of Regulation (EU) 2023/1114 (MiCA) and it is not recorded using distributed ledger technology, and it is not a financial instrument.

12.8. How EIT is earned. You obtain EIT points exclusively through activity in the App: scanning trees, tree stories, Reports, quests, quizzes, taking part in leagues, referrals and similar actions, in accordance with the rules the App shows alongside each activity. Part of the awards depends on an assessment by artificial intelligence (Article 14). EIT points are not sold for money. If in the future we introduce the possibility of buying EIT points, we will first publish separate rules (including the right of withdrawal and refund for paid points) and technically separate paid points from earned points.

12.9. Correcting errors. We are entitled to correct an EIT balance if it arose from a technical error, a malfunction, misuse or an automated tool. We will inform you of the correction and of the reason for it. This entitlement does not cover EIT properly obtained through permitted activity.

12.10. Changes to the rules. We may change the rules on earning and spending EIT points where there is a justified reason, in particular for the development of the App, game balance, prevention of misuse or compliance with the law. We inform you at least 15 days in advance of any material change that is unfavourable to you. EIT points already earned are not taken away by a change.

12.11. Termination. Deleting or closing your Account ends the right to use EIT points without any right to compensation. The same applies if we permanently stop providing the App, subject to the notice in Article 20.

12.12. Inactivity. EIT points do not expire because of account inactivity. If we ever change this, the rules in section 12.10 (changes to the EIT rules) will apply, with an email notice at least 30 days before expiry.

13. The game, leagues, leaderboards and prizes

In short: leagues and leaderboards are competitions of skill and effort: whoever maps more and better ranks higher. There is no luck and no draw. Prizes are EIT, digital items and, for published thresholds, physical prizes.

13.1. How ranking works. In leagues and on leaderboards you are ranked exclusively according to a measurable result in the competition period (for example the number of EIT points earned in a week, the number of trees mapped, quests completed). We publish the criteria and the points table in the App before each period begins and we do not change them during the period.

13.2. No chance. The winner is determined exclusively by the result achieved on the leaderboard. There is no draw and no element of chance. In the event of an equal number of points, priority goes to the participant with the earlier timestamp of their last scored contribution; if that is also equal, priority goes to the participant with the higher number of distinct trees mapped in the period, and then to the participant with the longer Account history.

13.3. Participation. Participation is free and open to all users with an Account on equal terms. No payment affects your position in a league or on a leaderboard.

13.4. Prizes. Prizes in leagues are EIT points and digital items (Card frames, badges, statuses). In addition, users who reach thresholds of total activity published in advance (for example total ecological effect and distance covered while mapping) may request a physical prize from the selection we publish in the App (for example clothing or equipment). The selection, the thresholds and the quantities of prizes may change, but a threshold you have already reached remains valid.

13.5. Collecting physical prizes. For a physical prize you enter a name, an address and a telephone number for delivery. We currently deliver prizes to addresses in Croatia, through the delivery service we choose for sending prizes. We send the prize within 30 days of the request; if a prize is unavailable, we will offer a replacement prize of the same or higher value. Prizes cannot be exchanged for money. You pay nothing to collect a prize; we bear the delivery costs. Minors collect a prize with a parent or guardian (Article 4.4).

13.6. Legal nature. These competitions are prize competitions in which winners are determined by result, without any element of chance, and they are not considered a prize game within the meaning of the Croatian Games of Chance Act (Zakon o igrama na sreću) or of the Ordinance on the Organisation of Prize Games (Pravilnik o priređivanju nagradnih igara). The competitions are announced on equal terms with the possibility of participation for everyone.

13.7. Fair play. We may cancel results obtained in breach of the Terms (fake trees, spoofed location, multiple Accounts, automated tools, exploiting bugs) and exclude the user from the competition, with a statement of reasons and a right of appeal under Article 11. If this is established after a prize has been awarded, we may request the return of the physical prize or of its value.

13.8. Results are public. On leaderboards and in leagues we show your nickname (or your name, if you have enabled that yourself in Settings, or "Private user" under Article 9.9), your avatar, your result and, on local leaderboards, the city or region where you map.

13.9. Exclusions. Our employees and members of their immediate family may take part in leagues, but they cannot collect physical prizes.

13.10. The app stores are not sponsors. Apple Inc. and Google LLC are not sponsors, organisers or endorsers of any competition or prize in the App and are in no way involved in them. We publish the rules of each competition with prizes in the App before the competition starts, as a separate document called "League and Prize Rules".

14. Artificial intelligence in the App

In short: artificial intelligence (AI) identifies the tree species, assesses photographs, stories and Reports, and draws Card images. AI makes mistakes. Any negative AI decision can be reviewed by a person if you ask for it. Card images are artificially generated and are labelled as such.

14.1. What the AI does. In the App we use artificial intelligence systems for:
- identifying the tree species from photographs and estimating its characteristics;
- assessing whether a scan, a video story or a Report is authentic and appropriate and whether it matches the quest, which determines the award of EIT points, the publication of content and the status of a Report;
- detecting faces and licence plates in order to protect privacy;
- generating Card images, short texts (for example facts about a tree) and translations.
For this we use models from external providers (currently Google, OpenAI and Pl@ntNet for botanical species identification) through our servers. Which data we send them is explained in the Privacy Policy.

14.2. We are the provider of the system. Agilos IT d.o.o. is the provider of the AI system in the App within the meaning of Article 3(3) of Regulation (EU) 2024/1689 (AI Act), as amended by Regulation (EU) 2026/1744, and we, not the model providers, are responsible towards you for its use.

14.3. Labelling. Where an assessment is produced by AI, this is clearly marked in the App at first display. Card images and other AI-generated content are marked as artificially generated with a visible label and contain a machine-readable digital watermark. You must not remove or conceal the labels and the watermark when you share a Card.

14.4. AI makes mistakes. AI results are estimates. The tree species may be wrong, an authentic photograph may be rejected, and age, height and CO2 effect are approximate. An AI assessment is not a professional opinion about a tree or about danger (Article 8.3).

14.5. Your right to human review. If the AI rejects your scan, story or Report, awards fewer EIT points than you expected, or rates content as inappropriate, you can ask in the App or at podrska@picusgo.com for one of our staff to review the decision, put forward your point of view and contest the decision. The review is carried out by a person who has the authority to change the outcome. We reply within 15 days, and if your request is well founded we correct the outcome (for example we award the EIT points or publish the content).

14.6. AI does not close Accounts. An automated system never closes an Account on its own and never takes away EIT points that have already been awarded; such decisions are made by a person (point 11.5).

14.7. Cards as digital items. A Card is a digital item that the App creates for your Account, partly with the help of AI. We grant you a personal, non-transferable right to use the Card inside the App, and to display and share it for personal, non-commercial purposes using the features the App offers. You must not sell a Card, use it commercially, reproduce it in bulk, use it to train artificial intelligence models or use it to develop a similar product. A Card carries our trade marks and visual frame (Article 19). A Card is not issued as a crypto-asset or a non-fungible token and is not recorded using distributed ledger technology.

14.8. Your photographs and AI. Your photographs and videos are used for AI processing only for the purposes set out in point 14.1. Under their contracts with us, our model providers (currently Google, OpenAI and Pl@ntNet for botanical species identification) do not use your data to train their models. The details are in the Privacy Policy.

15. Purchases, payments and donations

In short: you pay nothing in the App. There are no purchases, payments or donations; all features are free.

15.1. There are currently no purchases or payments in the App. All features are free; EIT points are earned exclusively through activity (Article 12).

15.2. The App does not collect donations. If we ever make it possible to support the project with money, this will be exclusively on our website, not in the App.

15.3. If in the future we introduce purchases in the App (for example printed cards or digital benefits), we will first publish separate terms of purchase with information on the price, the payment method, delivery and your right of withdrawal, and ask for your express agreement; such purchases will go through the app store's purchase system where the store's rules require it.

16. What "tree protection" means

In short: "tree protection" in PicusGO is a digital, symbolic status in the game that you obtain with EIT points, not money. You do not acquire ownership of or a right to the tree, we do not guarantee that the tree will survive, and the CO2 figures are estimates.

16.1. In the App you can "protect" a tree with EIT points; protection is not paid for with money. This means that the tree in the App receives a protection badge, your nickname (or a name you choose yourself) as its protector, and the associated digital benefits, for the period shown in the App, which you can renew.

16.2. Tree protection in the App is an ecological and game action and gives you no ownership, possession, right of disposal, right of use or any other real or contractual right in the tree or in the land on which the tree grows. The tree belongs to its owner, who disposes of it in accordance with the law; we have no influence on this.

16.3. We do not guarantee that the tree will survive. A tree may be damaged, fall ill, be felled or be removed for reasons beyond our control. In that case we transfer the protection status in the App, where possible, to another tree, or we record it as a memory of the tree; we do not refund EIT points spent.

16.4. Ecological data are estimates. Data on the species, age, height, CO2 absorption and other effects of a tree shown by the App are estimates based on our methodology and on artificial intelligence models. They are indicative and must not be taken as authoritative, binding or scientifically verified data for an individual tree.

16.5. No offsetting claims. Tree protection and EIT points do not constitute compensation, neutralisation or reduction of your carbon footprint, and we make no such claims. The App records your contribution to mapping and caring for trees; what actually happens to the environment depends on many other factors.

17. Referral programme

In short: you can invite friends with your code and receive EIT points when they register and map a tree. Fake accounts and bulk invitations are not allowed.

17.1. Every Account has its own referral code. When a person you invite opens an Account with your code and meets the conditions shown in the App (for example a first scan), you both receive EIT points under the published rules. The rules and the amounts may change in accordance with Article 12.10.

17.2. You may share the code personally, in messages and on social networks, in a way that does not breach the rules of those platforms or the law on unsolicited messages. You must not: open Accounts for yourself or for others in order to obtain a reward, use purchased or automated registrations, pay or mislead others into registering, or present yourself as PicusGO.

17.3. We cancel rewards obtained in breach of these rules in accordance with Article 11.

17.4. If you invite someone, we may not and will not use their contact details without their consent; the App does not access your address book.

18. Notifications and communication

In short: we send you in-app notifications, push notifications and e-mail. You cannot switch off service notifications; you can switch off motivational and promotional ones in Settings.

18.1. Service notifications (about your Account, security, moderation, changes to the Terms, the status of a scan or a Report) are sent to you by e-mail and in the App, because they are necessary for providing the service.

18.2. Push notifications are sent to you only if you allow notifications in your device settings. In the App Settings you can switch individual notification categories on or off separately (for example social, motivational, leagues, stories, general), set quiet hours and set the frequency. Notifications that encourage you to return to the App or that promote content are sent only if those categories are switched on.

18.3. We do not send promotional e-mail without your consent. If we introduce it in the future, every message will include an unsubscribe option.

18.4. Messages you send us at podrska@picusgo.com are kept in order to resolve your request and to maintain the record of complaints (Article 24).

19. Our intellectual property rights

In short: PicusGO, Picus, the logo, the design, the code, the texts, the sounds, the Cards and the tree database are ours or our partners'. Use them only inside the App.

19.1. The names PicusGO and Picus, the logos, the mascot Picus, the visual frame and design of the Cards, the graphics, animations, sounds, texts, program code and all other components of the App, apart from your Content and other users' Content, are protected by copyright, trade mark and other rights and belong to Agilos IT d.o.o. or to our licensors.

19.2. Agilos IT d.o.o. is the maker of the PicusGO database (trees, Reports, Cards, results and related data) within the meaning of Article 173 of the Copyright and Related Rights Act (Zakon o autorskom pravu i srodnim pravima, NN 111/21). Extraction and re-utilisation of a substantial part of the contents of that database, as well as repeated and systematic extraction of insubstantial parts, is prohibited without our written approval. Map backgrounds belong to their providers (for example Mapbox, OpenStreetMap) under their terms.

19.3. We grant you a personal, non-exclusive, non-transferable and revocable right to install and use the App on your devices in accordance with these Terms and with the rules of the store you downloaded it from. You must not copy, modify, decompile, resell or rent out the App, remove rights notices, or use our trade marks without approval, except to the extent permitted by mandatory law.

19.4. Content you share outside the App using the sharing features (for example an image of a Card or of a tree) may be shared for personal, non-commercial purposes, with our labels. For any other use (schools, associations, media, partners) contact us at podrska@picusgo.com; we will be glad to approve reasonable requests.

19.5. If you send us a suggestion or an idea for the App, we may use it without any obligation to pay, unless we agree otherwise in writing.

20. Availability of the App, changes to features and discontinuation of the service

In short: we do our best to keep the App running, but we cannot guarantee uninterrupted operation. We change features for the reasons listed; we inform you in advance of material unfavourable changes. If we shut the App down, we will tell you 60 days in advance.

20.1. Availability. We aim to keep the App available at all times, but it may be temporarily unavailable because of maintenance, updates, faults, overload, actions of third parties (providers of hosting, maps, artificial intelligence, app stores) or force majeure. We announce planned maintenance in the App where this is possible.

20.2. Updates. We supply updates, including security updates, that are needed to keep the App in conformity with the contract, for the period during which you can reasonably expect this, and at least for as long as the App is available in the stores. Some updates are installed automatically inside the App and some require a download from the store. If you do not install an update within a reasonable time, we are not liable for defects that arise as a result.

20.3. Changes to features. We may change the features of the App beyond what is necessary to maintain conformity only for the following reasons: the safety of users and of the system; compliance with the law or with decisions of competent authorities; technical viability (changes to operating systems, stores or external services we depend on, or such a service being discontinued); the balance and development of the game and the community; bug fixes and accessibility improvements. You receive the change at no additional cost. If a change negatively and more than insignificantly affects your access to the App or your use of it, we will inform you in advance by e-mail, and you have the right to terminate the contract free of charge within 30 days of the notice or of the change, whichever is later.

20.4. Discontinuation of the service. If we decide to permanently stop providing the App or a material part of it, we will inform you at least 60 days in advance by e-mail and in the App, and allow you to use up your EIT points and download your Cards and data by then.

20.5. External services. The App depends on third-party services (app stores, Apple and Google sign-in, maps, artificial intelligence, hosting). We are not liable for their operation, their terms or any interruptions, unless we caused them ourselves.

21. Liability

In short: for what we cause intentionally or through gross negligence, and for personal injury, we are liable without limitation. For ordinary negligence we are liable within the limits of foreseeable damage. Your statutory rights as a consumer always remain.

21.1. Agilos IT d.o.o. is liable without limitation for damage caused intentionally or through gross negligence, as well as for damage arising from injury to life, body or health.

21.2. For other damage caused through ordinary negligence we are liable only if a material contractual obligation has been breached, that is, an obligation whose fulfilment is a precondition for the proper performance of the contract in the first place and on which you justifiably rely, and then only up to the amount of the damage that was foreseeable and typical for a service of this kind at the time the contract was concluded. Liability for lost profit and for indirect damage caused through ordinary negligence is excluded.

21.3. We are not liable for damage arising from: your breach of Article 7 (safety in the field) or Article 8 (Reports); reliance on estimates from the App contrary to Articles 5.3, 8.3, 14.4 and 16.4; the acts of other users or of third parties; or circumstances beyond our control that we could not foresee or avoid (force majeure), in each case to the extent that we did not cause the damage intentionally or through gross negligence. If your own conduct contributed to the occurrence or the extent of the damage, you bear a proportionate part of it.

21.4. We provide the App to you with the care of a diligent expert, but we do not guarantee that it will work without interruptions and errors, that tree data will be accurate, or that you will achieve a particular result in the game. This does not reduce our guarantees of conformity of digital content and services that you have under the law.

21.5. Nothing in these Terms excludes or limits the rights you have under the mandatory consumer protection law of the country of your habitual residence, nor your right to bring a dispute before the courts of that country.

22. Indemnification

In short: if your unlawful content or your breach of the Terms causes a third party to bring a claim against us, you will reimburse us for our justified costs, within the limits of the law.

22.1. If a third party (for example a person shown in your photograph, a landowner, a copyright holder) brings a claim against us because of your Content or your breach of Articles 7, 8, 9 or 10, and that claim is the result of your intentional or negligent conduct, you will reimburse us for the justified costs and damage we suffer as a result, to the extent and within the limits permitted by law. We will inform you of the claim without delay and give you the opportunity to state your position in the proceedings.

22.2. This provision does not apply to the extent that the damage was caused by our own failure, and it does not reduce your statutory rights as a consumer.

23. Changes to these Terms

In short: we may change the Terms for the reasons listed. We will tell you at least 30 days in advance. If you do not agree, you can terminate the contract at no cost.

23.1. We may amend these Terms for the following reasons: compliance with the law, with court or administrative decisions and with app store rules; the introduction, modification or removal of App features under Article 20; the safety of users and of the system; the prevention of misuse; the correction of errors and clarification of the text; changes in our business (for example new service providers).

23.2. We inform you of a change at least 30 days before it takes effect, by e-mail and by a notice in the App, showing what is changing and the new text. Minor changes that are not unfavourable to you (for example correcting a typo, a change of address) may be published without that notice period, with a notice.

23.3. If you do not agree with a change, you can terminate the contract without any charge up to the day the change takes effect, by deleting your Account or by a message to podrska@picusgo.com. If you continue to use the App after the change takes effect, the amended Terms apply to you; at your first sign-in after the change we will ask you to confirm this expressly.

23.4. A change does not take away EIT points or Cards you have already obtained and does not have retroactive effect.

24. Complaints, governing law and dispute resolution

In short: send us a complaint by e-mail or post; we reply within 15 days. Croatian law applies, but as a consumer you keep the protection of the law of your own country and you can sue in your own country.

24.1. Complaints. You can submit a complaint by e-mail to podrska@picusgo.com or by post to Agilos IT d.o.o., Oreškovićeva ulica 6H, 10000 Zagreb. We confirm receipt without delay and deliver a written reply setting out our position on the merits within 15 days of receipt. We keep the record of complaints for one year. Information on how to submit a complaint is also displayed at https://picusgo.com.

24.2. Out-of-court dispute resolution. If you are not satisfied with our reply, you can try to resolve the dispute before one of the bodies for alternative resolution of consumer disputes on the list kept by the Croatian ministry responsible for consumer protection (for example the Mediation Centre at the Croatian Chamber of Economy, Rooseveltov trg 2, Zagreb), or before the corresponding body in your country of residence. Participation in such proceedings is voluntary for us; we will decide on each proposal and inform you. The European platform for online resolution of consumer disputes ceased operating on 20 July 2025.

24.3. Governing law. These Terms were originally drawn up in Croatian. Translations into other languages serve to make them easier to understand. The law of the Republic of Croatia applies to this contract, in accordance with Regulation (EC) No 593/2008 (Rome I). That choice does not deprive you as a consumer of the protection afforded by provisions that cannot be derogated from by agreement under the law of the country of your habitual residence.

24.4. Jurisdiction. As a consumer you can always sue before the court of your domicile, and we can sue you only before the court of your domicile, in accordance with Regulation (EU) No 1215/2012 (Brussels Ia). For users who are not consumers, the court with subject-matter jurisdiction in Zagreb has jurisdiction.

24.5. Supervisory authorities. Consumer protection in Croatia is the responsibility of the State Inspectorate (Državni inspektorat), personal data protection is the responsibility of the Croatian Personal Data Protection Agency (AZOP), and digital services are the responsibility of HAKOM. Their contact details are given in the Privacy Policy and on their websites.

25. Final provisions

In short: if a provision is invalid, the rest still applies. The Croatian version is authoritative, but a translation never takes rights away from you.

25.1. Entire agreement. These Terms, the rules of individual competitions and campaigns published in the App, and the Privacy Policy (as a notice) form the whole of our relationship. In the event of a discrepancy between the Terms and the rules of an individual competition, the rules of that competition apply to that competition, unless they are less favourable to you than the Terms.

25.2. Invalidity of an individual provision. If a provision of these Terms is null or unenforceable, this does not affect the other provisions. The law applies instead of the null provision.

25.3. Interpretation. Provisions that are open to doubt are interpreted in your favour if you are a consumer. The headings and the "In short" summaries are there to help you find your way; in the event of a difference the full text applies, but the summary must not be interpreted to your detriment.

25.4. Languages. We publish the Terms in Croatian, English, German, French and Spanish. The original and authoritative version is the Croatian one. A translation cannot take away rights that you have under the Croatian version or under the law of your own country; if a translation gives you more rights than the Croatian version, the translation applies.

25.5. Transfer of the contract. We may transfer the contract and the rights under it to a company that takes over the provision of the App, with notice to you at least 30 days in advance and with your right to terminate free of charge if you do not agree with the transfer. You may not transfer your Account or your rights under the contract.

25.6. Waiver. If in a particular case we do not insist on the application of a provision, this does not mean that we have waived it.

25.7. Plain language. We write these Terms so that a 15-year-old can understand them; if anything is unclear, write to us at podrska@picusgo.com and we will explain.

25.8. Version. Version 1.0, 1 October 2026. Earlier versions of the Terms and the list of changes are available at https://picusgo.com/uvjeti. Date of entry into force: the day of publication in the App and on picusgo.com.

26. Additional terms for the Apple App Store

In short: if you downloaded the App from Apple's App Store, these ten points are required by Apple. The contract is with us, not with Apple; Apple is not responsible for the App, but it may directly require you to comply with these Terms.

26.1. Acknowledgement. These Terms are concluded exclusively between you and Agilos IT d.o.o., and not with Apple Inc. ("Apple"). Apple is not a party to these Terms and is not the owner of the App. We alone are responsible for the App and its content.

26.2. Scope of License. We grant you a non-transferable right to use the App on Apple-branded devices that you own or control, in accordance with the Usage Rules set out in the Apple Media Services Terms and Conditions, including the possibility for the App to be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing, where applicable.

26.3. Maintenance and Support. We alone are responsible for the maintenance and support of the App, as described in these Terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.

26.4. Warranty. We alone are responsible for all warranties relating to the App, whether express or statutory, to the extent that the warranties cannot be disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you, if one was paid. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever in respect of the App, and we alone are responsible for any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty.

26.5. Product Claims. We, and not Apple, are responsible for addressing your claims or the claims of third parties relating to the App or to your possession and use of the App, including: (i) product liability claims; (ii) claims that the App fails to conform to applicable legal or regulatory requirements; (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the use of the HealthKit and HomeKit frameworks should the App use them.

26.6. Intellectual Property Rights. If a third party claims that the App or your possession and use of the App infringes that third party's intellectual property rights, we alone, and not Apple, are responsible for the investigation, defence, settlement and discharge of any such claim.

26.7. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to an embargo by the Government of the United States of America or that has been designated by that Government as a country that "supports terrorism"; and (ii) you are not listed on any list of prohibited or restricted parties of the Government of the United States of America.

26.8. Developer Name and Address. Agilos IT d.o.o., Oreškovićeva ulica 6H, 10000 Zagreb, Croatia; contact by e-mail: podrska@picusgo.com. You can address all questions, complaints and claims relating to the App to that address.

26.9. Third Party Terms of Agreement. When using the App you must comply with applicable third-party terms of agreement, for example the terms of map or sign-in providers.

26.10. Third Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of the Terms, Apple acquires the right (and is deemed to have accepted that right) to enforce them directly against you as a third-party beneficiary.
